28 января 2022 года в здании Правительства Сахалинской области состоялась Всероссийская конференция для предпринимателей «ЗАБИЗНЕС: рейтинг регионов. Сахалинская область», организованная АНО «Платформа для работы с обращениями предпринимателей «ЗаБизнес.РФ» и Уполномоченный по защите прав предпринимателей в Сахалинской области.
Участниками мероприятия стали представители государственной власти и правоохранительных органов, бизнес-омбудсмен и деловые объединения, а также предприниматели Сахалинский области. На повестке встречи было озвучено два основных вопроса: меры противодействия силовому давлению на бизнес и цифровые решения для обеспечения и укрепления финансовой стабильности региона.
Сахалинская области лидирует в Дальневосточном федеральном округе по количеству обращений, поступивших на Платформу «ЗаБизнес.РФ». «Данный показатель свидетельствует о высокой деловой и инвестиционной активности бизнеса в регионе, его открытости и доверии к власти и правоохранительным органам, а также информированностью предпринимателей о существующих правозащитных возможностях. Сахалинская область — это регион, который абсолютно открыт для предпринимательского сообщества. Диалог между бизнесом и властью получается конструктивный — вопросы, которые сегодня стоят перед предпринимателями, разрешаются,» — отметила Генеральный директор Платформы «ЗаБизнес.РФ» Элина Сидоренко.
Она рассказала о системных проблемах, возникающих при взаимодействии бизнеса и власти. Так, острейшим вопросом являются коррупциогенные доследственные проверки. На втором месте следует возбуждение уголовных дел по ч. 4 ст. 159 УК РФ, которая, в отличие от привилегированного предпринимательского состава «мошенничества», позволяет избирать меру пресечения в виде заключения под стражу. Высок показатель жалоб на отказ в освобождения от уголовной ответственности в связи с возмещением причиненного вреда по ст. 76 УК РФ, игнорирование решений Арбитражных судов и судов общей юрисдикции.
«Наша задача — оздоровление предпринимательского климата в регионе, которое может быть построено на выработке правильных, надежных, эффективных и здоровых практик взаимодействия бизнеса и власти. Это приведет к повышению инвестиционной привлекательности и к снижению административного и, как следствие, силового давления,» — подчеркнула Элина Сидоренко.
Результативность Платформы подтверждается качественно и количественно. «За два года мы помогли несколькими сотням российских предпринимателей, в каждом случае восторжествовала справедливость. Несколько ярких побед мы одержали и в Сахалинской области, благодаря слаженной работе с прокуратурой и Уполномоченным по защите прав предпринимателей Андреем Коваленко,» — подвела итог Элина Сидоренко.
Защита прав добросовестных предпринимателей является приоритетной в деятельности всех органов власти, в том числе прокуратуры. Заместитель Генерального прокурора Российской Федерации Дмитрий Демешин отметил, что предприниматели ежегодно сталкиваются с одними и теми же проблемами: коррупцией, волокитой, истребованием излишних документов, необоснованными проверками. В 2021 году прокурорами в округе выявлено почти 17 тыс. нарушений закона в рассматриваемой сфере. К дисциплинарной ответственности привлечено около 2 тыс. должностных лиц, свыше 480 лиц наказаны в административном порядке. Количество запланированных на текущий год органами контроля проверок в ДФО сократилось более чем на четверть (с 29 тыс. до 21 тыс.), в Сахалинской области — на 30%. Контролерам Сахалина отказано в согласовании 57% внеплановых проверок ввиду их необоснованности. Благодаря прокурорскому вмешательству, в 2021 году перед предпринимателями погашена задолженность в размере более 5 млрд. руб. в следствие несвоевременной оплаты государственными и муниципальными заказчиками по исполненным контрактам, из них только в Сахалинской области бизнес получил 424 млн. руб. В завершении выступления Дмитрий Демешин остановился на задачах, поставленных органам прокуратуры: «жестко реагировать на факты необоснованных проверок, пресекать излишнее внимание к деятельности инвесторов и на инициирование уголовного преследования должностных лиц, допускающих противоправные действия в отношении хозяйствующих субъектов».
Со своей стороны Правительством Сахалинской области уделяется особое внимание вопросу снижения административных барьеров развитию бизнеса. Такое заявление сделал Председатель Правительства Алексей Белик. «Проведение данной конференции становится хорошей традицией. По словам прокурора Сахалинской области Вячеслава Шайбекова, в 2021 году прокурорами выявлено 940 нарушений федерального законодательства, в целях устранения которых внесено 522 акта прокурорского реагирования. Значительная работа проведена по защите бизнеса при осуществлении контрольно-надзорной деятельности: в 2021 году отказано в согласовании в 40% случаев. Из 78 криминальных деяний, совершенных субъектами предпринимательства (на 22% меньше, чем в 2020 году), в 3 случаях прокуроры не согласились с решениями о возбуждении дела, что обеспечило защиту прав субъектов МСП и освобождению от необоснованного привлечения к уголовной ответственности. Количество жалоб на нарушения при производстве предварительного следствия возросло в 2 раза, при этом каждое 6 обращение признано прокурорами обоснованным и удовлетворено, восстановлены права участников судопроизводства. Принципиальная позиция при осуществлении надзора по уже возбужденным уголовным делам привела к прекращению ряда уголовных дел.
Принципиальную позицию в отношении пресечения фактов административного и силового давления высказал врио начальника Управления МВД России по Сахалинской области Сергей Тринцуков. В производстве следственных подразделений находилось 27 уголовных дел о 98 преступлениях в сфере предпринимательской деятельности, расследования и решения по которым принимались строго в соответствии с действующим законодательством. По материалам доследственных проверок поступило 182 обращение от 28 предпринимателей. По результатам рассмотрения 4 обращения были поддержаны, были установлены нарушения норм УПК РФ, приняты меры дисциплинарного характера в отношение виновных.
Бэликто Базаров, Руководитель следственного управления Следственного комитета Российской Федерации по Сахалинской области, заверил, что в 2021 году сообщения, связанные с нарушением прав субъектов предпринимательской деятельности путем создания административных барьеров, в том числе вызванных коррупционными проявлениями, в Следственное управление не поступали. Уголовные дела по указанным фактам следователями не возбуждались. Вместе с тем возбуждено 76 уголовных дел в отношении должностных лиц по фактам коррупционных проявлений, из которых 20 направлено в суд.
Для дальнейшего формирования условий для благоприятного ведения бизнеса и привлечения инвестиций налажен прямой диалог бизнеса, власти и правоохранительных органов. Такую позицию высказали Уполномоченный по защите прав предпринимателей Андрей Коваленко, руководитель представительства АСИ в ДФО Ольга Курилова, руководители деловых объединений Сахалинской области.
Андрей Коваленко отметил постепенное уменьшение количества жалоб от предпринимателей, как и сокращение сроков их рассмотрения и выразил надежду, что с использованием новых методов взаимодействия положительная динамика не просто сохранится, но и будет наращивать обороты. Он акцентировал внимание на межведомственном взаимодействии по снижению административного давления на субъекты предпринимательской деятельности. По его словам, системные проблемы и частные обращения предпринимателей возникают в сфере реализации инвестиционных проектов (ТОСЭР), исполнения муниципальных контрактов, рыболовства и охраны водных биологических ресурсов, регулирования оборота алкоголя, назначения административных наказаний.
Руководитель представительства АСИ в ДФО Ольга Курилова заявила, с 2022 года Национальный рейтинг АСИ инвестиционного климата в регионах России дополнят новые критерии оценки, в него будет интегрирован Индекс «Административное давление». Сахалинская область находится в группе А по количеству запрашиваемых документов, количество надзорных мероприятий в год сократилось. Положительная динамика наблюдается в уменьшении доли компаний, столкнувшихся с давлением. По решению Рейтингового комитета прорабатыается добавление оценки силового давления на бизнес.
