На прошедшем 24 сентября заседании Общественного совета при Прокуратуре Сахалинской области по вопросам поддержки малого и среднего предпринимательства Председатель Регионального отделения «Опоры России» по Сахалинской области Юрий Дьяков и руководитель Комитета связей с общественностью и государственными структурами Регионального отделения Виктор Довгенко заявили, что Сахалинская прокуратура должна вынести оценку прошедшим выборам.
По мнению общественников, минувшие выборы должны стать поводом для детального рассмотрения эффективности деятельности избирательной комиссии, а то, что Сахалинская область продемонстрировала самую низкую явку в России само по себе должно стать предметом отдельного «разбора полетов».
Социологические причины того, почему 80% населения Сахалинской области проигнорировали выборы, общественники видят отнюдь не в «сборе картошки» и хорошей погоде для пикников. Избиратели, по мнению Сахалинской «Опоры России», не нашли в числе кандидатов тех лиц, которых бы они захотели поддержать своими голосами. И очевидно, что не последнее значение в этом сыграла череда отказов избирательных комиссий в регистрации лиц в качестве кандидатов на выборах.
Если рассматривать картину выборов в Южно-Сахалинске, то из 174 кандидатов в депутаты Городской Думы Южно-Сахалинска 53 получили отказ в регистрации по разным основаниям. На 12 кандидатур на пост мэра областного центра пришлось 4 отказа в регистрации. Следует отметить, что в этом году отмечается высокое число отказов, вынесенных на основании некорректности заполнения подписных листов самовыдвиженцев. Речь идет о листах с подписями избирателей по конкретным избирательным округам, которые таким образом выдвигают конкретных лиц для избрания.
Спорным моментом в шаблоне подписного листа стала графа «дата голосования», где, если задуматься, можно проставить либо дату внесения избирателем самой подписи, либо дату проведения выборов. Примечательно, что на этапе подготовки к выдвижению представители потенциальных кандидатов озадачились тем же вопросом и обратились для разъяснения в избирательные комиссии по округам, где, как они предполагали, должны даваться четкие, достоверные и единственно верные методические указания. Увы, на практике все оказалось наоборот.
В избирательных комиссиях представителям кандидатов заявили, что в графе «дата голосования» необходимо проставлять дату подписания документа, что казалось очевидным – в России установлен единый день голосования и дублировать эту дату, по меньшей мере, неинформативно. Каково же было удивление потенциальных кандидатов, когда при регистрации им было отказано по причине некорректности заполнения именно этих документов – в той злосчастной графе, как выяснилось, необходимо было проставлять дату проведения самих выборов.
Выходит, что кандидатам, столкнувшимся с двоякой трактовкой закона, не стоит уповать на компетентность специалистов избирательной комиссии, которые то ли сознательно (чего также нельзя исключать), то ли по незнанию предоставляют неверные консультации. Как итог – избиратели, которые не нашли тех, за кого готовы были отдать голоса, попросту не пришли на выборы.
Но на этом история с выдвижением для отдельного ряда кандидатов не закончилась. За решением вопроса они были вынуждены обратиться в городской суд, где в нарушение закона дата заседания была назначена через 18 дней с момента подачи иска. Не следует забывать, что когда судебный спор касается вопросов выборов, то такие процессы проходят в пятидневный срок. В результате в избирательные бюллетени не попал целый ряд самовыдвиженцев.
Как отметил Виктор Довгенко, который также получил отказ в регистрации в качестве кандидата, серьезные вопросы вызывает тот факт, что по аналогичным процессам один и тот же судья выносит диаметрально противоположные решения. В качестве яркого примера приводится история с двумя параллельными процессами по отказу в регистрациях из-за некорректности заполнения поля «дата голосования» в подписных листах. При рассмотрении иска Виктора Довгенко судья Князева признала решение избирательной комиссии справедливым. Парадокс заключается в том, что при рассмотрении аналогичной ситуации, в которой истцом выступила кандидат в депутаты от партии «За женщин России» Светлана Латышенко, судья вынесла совершенно иной вердикт, признав решение избиркома незаконным. Таким образом, Светлана Латышенко была зарегистрирована в качестве кандидата, а Виктор Довгенко – нет. Невольно возникает вопрос о единообразии правоприменительной практики и том, какие причины заставили судью Князеву опровергнуть фактически собственную судебную практику.
Завершая свое выступление на общественном совете при прокуратуре Сахалинской области, представители Сахалинской «Опоры России» указали на явную «дыру» по этому вопросу в законодательстве о выборах. И систематичность описанных инцидентов должна стать поводом для, как минимум, инициирования изменения данного белого пятна в избирательном законодательстве.
