Председатель Сахалинского отделения Общероссийской общественной организации малого и среднего бизнеса «ОПОРА РОССИИ» призывает не допустить закрытия кафе «Лиана» по формальному поводу, а подумать об интересах жителей.
Громким событием для сахалинцев и курильчан стала новость о том, что индивидуальному предпринимателю придется освободить земельный участок, расположенный юго-восточнее стороны средней площадки горы Большевик на территории спортивно-туристического комплекса «Горный Воздух», путем демонтажа объекта «Кафе Лиана».
Прокурорской проверкой установлено, что земельный участок лесного фонда, находящийся в федеральной собственности, был предоставлен предпринимателю на основании договора с ОАУ «СТК Горный воздух» для размещения временного объекта мелкорозничной торговли общественного питания, который впоследствии оказался расторгнутым. Вместе с тем, фактически на указанном земельном участке возведен и эксплуатируется объект капитального строительства — кафе «Лиана», в отсутствие предусмотренной законом разрешительной документации.
Судебной коллегией по административным делам Сахалинского областного суда оставлено без изменения решение Южно-Сахалинского городского суда, которым удовлетворено исковое заявление прокурора областного центра по данному поводу.
«Вместе с тем, считаем непоправимым последствием производить демонтаж объекта «Кафе Лиана» по одним только формальным основаниям отсутствия разрешительной документации, поскольку в настоящее время предпринимателем осуществляются все меры для упорядочения отношений с органами государственной власти и получения разрешительной документации», — считает Юрий Дьяков. – Тем более что высокопоставленные чиновники областного правительства сами уговаривали предпринимателей открыть кафе на этом месте несмотря на проблемы с документами. Они обещали со временем уладить этот вопрос и предоставить аренду на 49 лет. Теперь этих чиновников уже нет на своих постах, а виноватыми остались представители малого бизнеса. Это не правильно», — высказал свою твердую уверенность Юрий Дьяков.
Следует отметить, что кафе «Лиана» располагается на территории спортивно-туристического комплекса «Горный Воздух», который в силу своей всесезонности, а также уникального расположения в центре столицы Сахалинской области, городе Южно‐Сахалинске, ежедневно принимает огромное количество сахалинцев и гостей города.
После активного отдыха на склонах горнолыжного курорта, несомненно, требуется восполнение сил. Для этого на «Горном воздухе» работает кафе «Лиана», которое уже успело хорошо себя зарекомендовать перед сахалинцами и гостями нашей столицы.
