Во Владивостоке состоялась встреча должностных лиц Дальневосточного таможенного управления (ДВТУ) и Владивостокской таможни с делегацией Министерства экономики, торговли и промышленности Японии и представителями японских компаний, посвященная вопросам защиты прав интеллектуальной собственности. Встреча организована при содействии ООО «Городисский и партнеры».
Во встрече приняли участие начальник отделения таможенного сотрудничества ДВТУ Элла Грибова, начальник отдела торговых ограничений и экспортного контроля службы федеральных таможенных доходов ДВТУ Светлана Коваль и другие должностные лица подразделений торговых ограничений и экспортного контроля ДВТУ и Владивостокской таможни.
С японской стороны участвовали сотрудник подразделения защиты прав интеллектуальной собственности Министерства экономики, торговли и промышленности Японии Емото Марико, вице-консул Генерального консульства Японии во Владивостоке Такаянаги Кэйта, а также представители японских компаний Hino Motors Ltd., Nishimura&Asahi Law Office. В организации и проведении встречи активное участие принял патентный поверенный Масаси Куросэ (Kurose IP Management).
В Японии проблеме защиты прав интеллектуальной собственности уделяется большое внимание, так как наличие на рынке контрафактных товаров влияет на репутацию японских компаний. О деятельности подразделения по защите прав интеллектуальной собственности Министерства экономики, торговли и промышленности Японии рассказала Емото Марико. Основная цель подразделения – защита нарушенных прав японских правообладателей. В компетенцию подразделения входит также оказание консультаций, разработка рекомендаций, взаимодействие и обмен информацией с таможенными органами и полицией, объединениями правообладателей и т.д. На международном уровне реализуются программы проведения исследований в области защиты прав интеллектуальной собственности, с 2009 года в различных странах регулярно организуются международные семинары по этой теме, в том числе два проведено в России – в Москве и Санкт-Петербурге. Как правило, семинары проводятся во взаимодействии с Японской организацией по развитию внешней торговли ДЖЕТРО (JETRO).
Японские участники встречи подчеркнули заинтересованность во взаимодействии с таможенными органами ДВТУ, так как многие контрафактные товары с использованием японских брендов поступают в Россию через Дальний Восток и деятельность таможенных органов Дальнего Востока по выявлению такой продукции и предотвращению ее ввоза имеет ключевое значение.
Дальневосточные таможенники сообщили, что в таможенных органах России на постоянной основе проводится работа по вопросам защиты прав интеллектуальной собственности.
Федеральная таможенная служба ведет Таможенный реестр объектов интеллектуальной собственности, в котором из года в год увеличивается количество включенных товарных знаков. Сегодня в реестр включено около 4,5 тысячи товарных знаков, из них более 140 – японских.
Каждый год Федеральная таможенная служба проводит общероссийские или региональные семинары с участием правообладателей, в ходе которых таможенным органам передается информация об отличительных признаках оригинальной продукции и признаках контрафакта. Иногда правообладатели передают в таможенные органы считыватели меток. Вся эта информация активно используется в работе.
На Дальнем Востоке основными группами контрафактных товаров, задерживаемых таможенными органами ДВТУ, являются игрушки, предметы одежды, обувь, аксессуары, пробки для закупорки стеклянной тары, автомобильные запчасти.
Для повышения эффективности работы по защите прав интеллектуальной собственности в ДВТУ существует практика проведения встреч с иностранными организациями по теме защиты прав интеллектуальной собственности, в частности с японской организацией ДЖЕТРО.
Встреча носила конструктивный характер и прошла в дружественной атмосфере. Обе стороны пришли к выводу о необходимости международного сотрудничества по вопросам защиты прав интеллектуальной собственности.
В завершение встречи представители японской стороны поблагодарили представителей ДВТУ и Владивостокской таможни за продуктивный диалог. И предложили провести во Владивостоке семинары по защите прав интеллектуальной собственности с привлечением представителей таможенных органов.
ДВТУ со своей стороны пожелало японским правообладателям активнее назначать уполномоченных импортеров на Дальнем Востоке России.
