Его уже назвали «Предпринимательский Пленум».
Верховный суд РФ выступил за запрет заключения под стражу подозреваемых по ряду экономических статей Уголовного кодекса.Верховный суд РФ предлагает запретить заключать под стражу подозреваемых по ряду экономических статей Уголовного кодекса, в том числе о махинациях в сфере предпринимательской деятельности и отмывании преступных доходов, передает корреспондент РИА Новости с заседания пленума ВС РФ.
В частности, разъяснена часть 1 статьи 108 УПК РФ:
устанавливает запрет на применение меры пресечения в виде заключения под стражу в отношении подозреваемого или обвиняемого в совершении преступлений, предусмотренных статьями 171 — 174, 174.1, 176 — 178, 180 — 183, 185 — 185.4, 190 — 199.2 УК РФ, без каких-либо других условий, а в отношении подозреваемого или обвиняемого в совершении преступлений, предусмотренных статьями 159 — 159.3, 159.5, 159.6, 160 и 165 УК РФ — при условии, что эти преступления совершены в сфере предпринимательской деятельности.
Речь, в частности, идет о разглашении сведений, составляющих банковскую, налоговую или коммерческую тайну, растрате средств, мошенничестве в сфере предпринимательской деятельности, легализации денежных средств, манипулировании рынком, незаконном обороте драгоценных металлов и других статьях УК РФ экономической направленности.
Суд поясняет, что если обвиняемый имеет постоянную регистрацию в России, его личность установлена, он не нарушал ранее избранную меру пресечения и не скрывался от органов следствия и суда, то оснований для его помещения в СИЗО нет.
Проект пленума также предлагает не сажать под арест соучастников предпринимателей при аналогичных условиях.
«В то же время наличие вышеперечисленных обстоятельств не освобождает суд от обязанности в каждом случае обсуждать возможность применения иной, более мягкой, меры пресечения», — отмечает ВС РФ.
Он также разъяснил понятие предпринимательской деятельности: «Предпринимательской является самостоятельная, осуществляемая на свой риск деятельность, направленная на систематическое получение прибыли от пользования имуществом, продажи товаров, выполнения работ или оказания услуг лицами, зарегистрированными в этом качестве в установленном законом порядке».
С учетом этого «указанные преступления следует считать совершенными в сфере предпринимательской деятельности, если они совершены индивидуальным предпринимателем в связи с осуществлением им предпринимательской деятельности и (или) управлением принадлежащим ему имуществом, используемым в целях предпринимательской деятельности, а также членом органа управления коммерческой организации в связи с осуществлением им полномочий по управлению организацией либо при осуществлении коммерческой организацией предпринимательской деятельности».
Суд пока не принял проект пленума, и в него могут быть внесены изменения
