Минздрав России разработал законопроект1, в случае принятия заказчики не будут обязаны закупать у субъектов малого предпринимательства и социально ориентированных некоммерческих организаций лекарственные препараты в объеме не менее чем 15% совокупного годового объема закупок. Речь идет о лекарственных препаратах, включенных в перечень жизненно необходимых и важнейших, если при этом начальная цена контракта превышает 10 млн руб. Иными словами, соответствующие закупки не будут включаться в расчет совокупного годового объема закупок у субъектов малого бизнеса и социально ориентированных некоммерческих организаций.
Автор инициативы указал, что в 2015 году было проведено 75 процедур закупок дорогостоящих лекарственных препаратов. Он обратил внимание на то, что необходимыми ресурсами и возможностями поставки дорогостоящих лекарственных препаратов обладают в основном крупные поставщики, а не субъекты малого предпринимательства. Отмечается, что последние фактически не принимали участие в процедурах определения поставщиков. Это, по мнению Минздрава России, связано с тем, что для гарантированного производства и поставки таких ресурсов в регионы требуются производственные мощности, технологическое оборудование, финансовые, трудовые и иные ресурсы, которыми субъекты малого бизнеса и социально ориентированные НКО не обладают.
Автор законопроекта пришел к выводу, что формальное проведение процедур закупок на поставку дорогостоящих лекарственных препаратов у субъектов малого предпринимательства и социально ориентированных НКО приведет к срыву и необоснованному увеличению сроков определения поставщиков. А такое положение вещей, по оценке министерства, приведет к не обеспечению населения России дорогостоящими лекарственными препаратами.
