Новый КоАП не нравится бизнесу

Не принимать новую редакцию КоАП предложил спикеру Госдумы Вячеславу Володину бизнес-омбудсмен Борис Титов. Вместо стимулирования деловой активности новый кодекс расширяет карательные и коррупциогенные меры против бизнеса и драконовскую штрафную политику. Под обращением к Госдуме подписались и главы деловых союзов.

В среду уполномоченный по защите прав предпринимателей Борис Титов направил на имя спикера Госдумы Вячеслава Володина обращение (имеется в распоряжении «Газеты.Ru»), в котором предложил снять с рассмотрения депутатами новую редакцию Кодекса об административных правонарушениях (КоАП). Новая редакция кодекса — наследство предыдущего созыва, готовое к принятию Госдумой.

«Вместо стимулирования деловой активности и экономического роста новый проект КоАП предлагает нам расширенный пакет карательных мер и драконовскую штрафную политику. Это последнее, что нужно делать в кризис», — пояснил Титов.

В таком виде КоАП принимать нельзя, уверен бизнес. «Позиция предпринимательского сообщества на этот счет консолидированная», — говорит Титов.

Не наращивать срок

Бизнес-омбудсмена возмущает с десяток положений законопроекта. Например, наличие в нем такой меры, как ликвидация юридического лица за ведение деятельности без разрешения либо при отсутствии членства в саморегулируемой организации.

Бизнес также против увеличения срока давности по ряду нарушений. В частности, за нарушения в налоговой сфере срок давности предлагается нарастить с года или двух до трех, а в антимонопольной — до четырех лет.

Неприемлем и рост штрафов в 10–100 раз. По некоторым статьям штрафы достигают 6 млн и даже 20 млн руб., то есть уровня, прописанного в Уголовном кодексе.

Из УК позаимствовано и разделение административных правонарушений на «грубые», «значительные» и «менее значительные». Это приведет к росту штрафов и непредсказуемой правоприменительной практике, считают в предпринимательском сообществе.

Возможности для манипулирования

Между тем разработчики КоАП даже не удосужились обосновать взрывное увеличение размера штрафов. И не провели дифференциацию штрафов в зависимости от вида предпринимательской деятельности, от оборота компании. Для малого и некоторых видов среднего бизнеса штраф в 20 млн де-факто будет означать ликвидацию.

Кроме того, новый КоАП допускает два дополнительных наказания за одно и то же нарушение.

Еще одна из претензий — «создание условий для манипулирования обстоятельствами, смягчающими и отягощающими ответственность по административным правонарушениям». Например, ущерб от противоправной деятельности предлагается оценивать по фиксированной формуле, что не всегда корректно.

Что особенно возмущает бизнес-сообщество, так это желание разработчиков нового КоАП ужесточить ответственность для бизнеса и одновременно освободить от ответственности исполнительную власть, муниципальные и казенные предприятия, наделенные правами юридических лиц и выступающие ответчиками.

Вредный для климата

Вместе с бизнес-омбудсменом под обращением к спикеру Госдумы с требованием кардинально переработать поправки в КоАП поставили свои подписи также ключевые главы бизнес-союзов: Сергей Шохин, глава Российского союза промышленников и предпринимателей, Алексей Репик, глава «Деловой России», Александр Калинин, президент «Опоры России», и Сергей Катырин, глава Торгово-промышленной палаты РФ.

К проекту кодекса у предпринимательского сообщества имеется много концептуальных замечаний, отмечает Катырин. «Избыточно жесткие меры вместо превентивных, несоответствие наказания тяжести допущенных бизнесом нарушений могут серьезно ухудшить бизнес-климат в стране, ограничат экономическую активность и не уменьшат административную нагрузку на бизнес», — говорит глава ТПП.

Действующий КоАП был принят в 2001 году, и с тех пор в него внесли 2,5 тыс. поправок. За время работы прошлого созыва 294 федеральных закона, то есть каждый шестой из принятых, содержал положения, вносящие изменения в КоАП. При этом вроде как никто не сомневается, что, несмотря на постоянные обновления, действующий КоАП нуждается в актуализации.

Новая версия КоАП должна была стать одним из козырных законопроектов в портфеле Думы прошлого созыва. Активнее других лоббировал новую редакцию кодекса председатель комитета по конституционному законодательству и госстроительству единоросс Владимир Плигин. Были, впрочем, и альтернативные варианты кодекса, от эсэров. Но уже на этапе внесения «победил» вариант Плигина.

Проект новой редакции КоАП был внесен на рассмотрение Госдумы в декабре 2015 года. Документ состоит из 1,6 тыс. страниц. Его обсуждали на профильном комитете около 20 раз.

Однако и плигинский вариант в итоге не был принят. Не без давления бизнес-сообщества, которое потребовало доработку поправок.

Были замечания и у правительства. В частности, по поводу введения состязательного процесса при рассмотрении административных дел — вызов в суд составивших протоколы о нарушениях полицейских и чиновников грозит большими финансовыми затратами.

В итоге новую редакцию кодекса оставили для рассмотрения Думе нового созыва, который приступил к работе в начале октября.

Бизнес-омбудсмен Титов надеется на диалог с обновленным депутатским корпусом.

«Дума в обязательном порядке должна быть и местом для дискуссий, и для диалога», — пообещал Вячеслав Володин, заступив на пост спикера нижней палаты парламента.

Впрочем, представители бизнеса скептически оценивают возможности по либерализации законодательства. «Уж сколько раз и президент, и премьер призывали не кошмарить бизнес, из года в год призывают, дескать, дайте наконец-то бизнесу спокойно расти, но контрольно-надзорные органы, силовики не могут допустить принятия прозрачных и превентивных правил игры», — говорит Андрей Шубин, исполнительный директор «Опоры России». Если кодекс не будет репрессивным и без возможности двойного толкования, многочисленные «проверяющие органы» могут лишиться привычной «кормушки». В этом реальная причина бесконечных переписываний и «улучшений» действующего законодательства, считает Шубин.

    Under the Twelfth Amendment, the Senate has the power to elect the vice president if no vice-presidential candidate receives a majority of votes in the Electoral College.
    The Constitution provides that the president may only
    «make Treaties, provided two-thirds of the senators present concur» in order to
    benefit from the Senate’s advice and consent and give each state an equal vote in the process.
    In the vice president’s absence, the president pro tempore, who is traditionally the most senior
    member of the Senate majority party, presides over the Senate, and more often by rule allows a junior senator
    to take the chair, guided by the parliamentarian.
