Пожарные — лидеры по количеству проверок бизнеса — смогут закрывать компании на три месяца за первое же нарушение требований пожарной безопасности. Для бизнеса это будет фактически означать разорение. Власти готовы снизить штрафы для компаний, нарушивших требования пожарной безопасности в период действия особого пожарного режима, с 400–500 тыс. до 200–400 тыс. руб. Но в качестве альтернативы пожарные инспекторы получат право приостанавливать деятельность компаний на срок до 90 суток. Такой законопроект одобрен правительственной комиссией по законопроектной деятельности, сказали РБК два участника заседания, состоявшегося 22 августа. Одобренные комиссией предложения чаще всего оформляются как правительственные законопроекты, которые имеют высокие шансы на принятие Госдумой.
Специальные наказания за нарушение противопожарных требований предложены в законопроекте для индивидуальных предпринимателей: штрафы в 20–30 тыс. руб. в обычное время и 40–50 тыс. руб. в период особого пожарного режима. При этом в последнем случае им тоже будет грозить альтернативная санкция в виде административного приостановления деятельности на срок до 90 суток, следует из текста законопроекта.
По действующему закону закрытие на три месяца предусмотрено лишь для компаний, которые повторно нарушают ряд конкретных противопожарных требований — к водоснабжению на случай пожара, эвакуационным путям, аварийным выходам, системам пожаротушения, сигнализации и т.д. Эти наказания могут применяться в любой период времени. Возможность закрытия за однократное нарушение противопожарных требований вводится в закон впервые.
По закону о пожарной безопасности власти вводят особый режим при повышенной пожарной опасности. Сам факт объявления такого режима дает пожарным инспекторам основания для внеплановых проверок компаний и организаций, при этом в отличие от внеплановых проверок других ведомств на эти не требуется разрешения прокуратуры, следует из закона. Минэкономразвития, которое обычно выступает за снижение административного давления на бизнес, согласовало законопроект, сообщила его официальный представитель Елена Лашкина. «Усиление ответственности за совершенные в условиях особого противопожарного режима нарушения правил противопожарной безопасности направлено на выполнение соответствующего поручения правительства России по данному вопросу и обусловлено повышенным риском совершения данных нарушений в пожароопасный период, призвано повысить эффективность борьбы с подобными нарушениями», — объяснила она РБК. Мера будет способствовать снижению риска гибели людей на пожарах, сокращению причиненного в результате совершения таких нарушений имущественного вреда, экономии бюджетных средств всех уровней, которые выделяются на покрытие такого ущерба, указала Лашкина. Новшество не затронет широкий круг предпринимателей, полагают в Минэкономразвития: по данным МЧС, на которые ссылаются в министерстве, в 2015 году по всей стране за нарушения в период действия особого пожарного режима было составлено 457 протоколов, в 2016 году — 129.
Цена инспекции
Согласно общему правилу, компании (за отдельными исключениями) должны проверяться раз в три года, в том числе и на предмет соблюдения правил пожарной безопасности. Но в 2015 году большинство (66%) проверок бизнеса были внеплановыми, сообщила РБК Генпрокуратура. МЧС, в ведении которого находится Государственный пожарный надзор (его сотрудники инспектируют компании, организации и граждан), наряду с Роспотребнадзором традиционно оказались лидерами по количеству проверок. На эти два ведомства пришлась треть от почти 2 млн организованных тогда инспекций — 395 тыс. провело МЧС, 266 тыс. — Роспотребнадзор.
В последний раз сотрудник Государственного пожарного надзора приходил два года назад и в ходе проверки «попросил» заказать проект паспорта пожарной безопасности у фирмы, аффилированной с самим проверяющим, рассказал РБК владелец заведения общепита. По словам бизнесмена, тогда стоимость разработки паспорта составляла от 100 тыс. до 200 тыс. руб., сумма зависела от конкретного объекта.
Другой собеседник РБК из числа бизнесменов называет похожий порядок сумм — 150–200 тыс. руб. Но теперь проверяющие из МЧС «стали другими», платить им ничего не нужно, говорит этот бизнесмен. Он верит, что пожарные инспекторы не будут использовать ужесточение законодательства в своих личных интересах: «Сейчас я не вижу никаких рисков от этих изменений».
МЧС стало совсем другим, согласна Блудян. По ее мнению, серьезных нарушений полномочий контролеры допустить не смогут: «Они закрыть предприятие (на 90 суток) могут только при наличии угрозы — если нет эвакуационного выхода, к примеру. Им нужно доказать опасность и наличие угрозы. Контролеры в этом смысле серьезно ограничены — решение о закрытии должен принимать вышестоящий руководитель. Этим будет не так просто манипулировать».

Согласно действующему закону, сотрудники Государственного пожарного надзора (входит в структуру МЧС) имеют право беспрепятственно входить на территорию любого, в том числе режимного, объекта, проверять их, запрашивать необходимые документы, выдавать предписания об устранении нарушений. Пожарные инспекторы также вправе проводить дознание по делам о пожарах, вызывать для дачи объяснений любых должностных лиц и рассматривать дела о таких происшествиях.
В случае изменения закона специальные и воинские подразделения Федеральной противопожарной службы сохранятся, следует из проекта. Но круг их полномочий в документе не очерчен.
