В ч. 2 повышен с 3 до 5 лет заключения минимальный порог наказания за незаконное обвинение в тяжком или особо тяжком преступлении либо обвинение, повлекшее причинение крупного ущерба или иные тяжкие последствия. Крупным в статье признается ущерб в 1,5 млн руб.Основной новеллой закона стало привлечение к ответственности должностных лиц правоохранительных органов при незаконном возбуждении уголовного дела для воспрепятствования бизнесу либо из корыстной или другой личной заинтересованности. Если это повлекло прекращение предпринимательской деятельности либо причинение крупного ущерба, виновному грозит от 5 до 10 лет заключения.
Одновременно поправками в УПК в ведение следователей СКР передано расследование преступлений, предусмотренных ст. 169 УК «Воспрепятствование законной предпринимательской или иной деятельности».
